The purpose of this Information Memorandum (IM) is to inform state and tribal title IV-B/IV-E agencies that pursuant to the Order and Final Judgment of the court in Texas v. U.S. Dep’t of Health and Human Serv., Case No. 6:24-cv-348-JDK (E.D. Tex.), Doc. 37 (filed June 13, 2025), the Designated Placements Final Rule is vacated in its entirety effective June 13, 2025.

This Program Instruction (PI) provides guidance to states, territories, and insular areas (hereafter “states,” unless otherwise noted) on actions required to receive Federal Fiscal Year (FY) 2026 allotments (subject to the availability of appropriations) under the formula grant programs authorized by title IV-B, subparts 1 and 2, section 106 of CAPTA, and the Chafee and ETV programs.

The purpose of this Program Instruction (PI) is to: (1) set forth the requirements for recipients of Community-Based Grants for the Prevention of Child Abuse and Neglect awards for FY 2025; and (2) provide guidance and instructions for the preparation and submission of the application and annual reports.

The purpose of this Information Memorandum is to inform state and tribal title IV-B and title IV-E agencies of a nationwide stay of the Designated Placements Final Rule and corresponding regulation at 45 CFR 1355.22.
