Dear Colleague:
OCSE has prepared the attached documents to assist you with the Family Violence Indicator (FVI) override process of the Federal Parent Locator Service (FPLS).
Section 454(26) of the Social Security Act sets forth certain state plan requirements regarding the confidentiality of information. That section, and federal regulations at 45 CFR 307.11, support efforts to: 1) create the Federal Case Registry (FCR) and State Case Registries (SCR); and 2) protect location information when disclosure could jeopardize the safety of parties or children.
Safeguarding information due to family violence raises a variety of issues. One consistent issue arises from the process set forth in section 454(26)(E) of the Social Security Act, which allows a court with proper authority as defined by sections 453(c)(2) or 463(d)(2)(B) to receive information from the FPLS despite the presence of an FVI. Please use the attached materials to facilitate the FVI override process effective immediately.
This supersedes DCL-98-122.
