Standard Terms and Conditions

The following apply to all awards administered by ACF.  Please note: Per 89 FR 80055 , the adoption of the eight provisions in 2 CFR Part 200  with an effective date of October 1, 2024 identified in the ACF Standard Terms and Conditions are in effect when awards or award amendments are issued that incorporates them by reference, beginning on or after October 1, 2024. 2 CFR Parts 200 and 300  Implementation effective 10/1/2025: Recipients that receive an updated T&C may immediately apply in full the 2 CFR Parts on 10/1/2025 without receiving an additional Notice of Award update. 

Property Terms and Conditions

Recipients with awards involving property must also follow the property related terms and conditions (PDF). Under 2 CFR §200.316, all real property, equipment, and intangible property acquired or improved with ACF funds must be held in trust by the recipient or subrecipient as trustee for the beneficiaries of the project or program under which the property was acquired or improved. ACF requires the recipient and subrecipient to record liens or other appropriate notices of record to indicate that the personal or real property has been acquired or improved with a Federal award and that use and disposition conditions apply to the award.
