Introduction
Section 658I(b)(1) of the Child Care and Development Block Grant Act provides the Secretary of the Department of Health and Human Services (HHS) authority for “review of compliance with State plan.” It authorizes that “the Secretary shall review and monitor State compliance with this subchapter and the plan approved under section 658E(c) for the State.” Additionally, the Child Care and Development Fund (CCDF) Final Rule at 45 CFR § 98.90, Subpart J provides the Secretary of the HHS the authority to monitor States for compliance with the CCDBG Act of 2014, the CCDF Final Rules, and the State’s approved CCDF Plan.
OCC Monitoring Purpose
Monitoring is one of OCC’s primary activities to confirm Lead Agencies’ implementation of key CCDF program Requirements:
- Oversight of the CCDF program
- Validate compliance of some key program requirements
- Support full implementation of CCDF
- Identify areas for technical assistance to support full implementation
Guiding Principles
Four key principles guide the monitoring process to ensure effectiveness:
- Transparent - Engage Lead Agencies throughout the process and ensure clear communication of expectations
- Data-driven - Scope informed by data on Lead Agency implementation
- Timely - Responsive timeline for communicating monitoring findings
- Informative - Clearly identify and communicate any areas of non-compliance and identify technical assistance to support full implementation
Monitoring Scope
The FFY 2025-2027 Monitoring process will evaluate Lead Agencies’ implementation of some Requirements across five Program Areas:
- Eligibility and Enrollment
- Equal Access
- Health and Safety
- Comprehensive Background Checks
- Program Integrity and Accountability
Focused Oversight Visits
The Office of Child Care conducts focused oversight visits on an as-needed basis to ensure compliance with specific program requirements as determined by OCC based on programmatic needs, risk assessment, and other relevant factors.

Please note, monitoring and oversight report findings reflect a point in time and are not subsequent updates to compliance status. Additionally, some states may have approved waivers for one or more provisions within the following requirements: Affordability, Payment Practices, Provider Options for Parents, and Posting Inspection Reports. The OCC Monitoring Reports identify these approved waivers as Plan Non-Compliances (PNCs). For earlier reporting cycles, see Cycle 2: FFY 2022—2024 CCDF Federal Monitoring Visits.
