The McNamara-O’Hara Service Contract Act
The McNamara-O’Hara Service Contract Act (SCA) (41 USC 351 et seq.) requires contractors and subcontractors performing services on prime contracts in excess of $2,500 to pay service employees in various classes no less than the wage rates and fringe benefits found prevailing in the locality, or the rates (including prospective increases) contained in a predecessor contractor's collective bargaining agreement. The Department of Health and Human Services (HHS) and Department of Labor have determined that the SCA labor standards provisions and procedures found at 29 CFR Part 4, apply to the Unaccompanied Children cooperative agreement grant awards. Wage determinations establish prevailing wages for localities within states (generally counties) for identified service employee positions. Wage determinations include minimum monetary wage rates, and minimum fringe benefits to be paid for the performance of SCA-covered services.
